9th Circuit and Virginia Court basically argued that "because Trump talked about a Muslim ban, then any immigration law which "targets Muslims" is with the intent of a ban." Imagine if this logic was applied to gun regulation, basing the intent off of campaign rhetoric. And they argued that Muslims have a right to immigrate because of the 1st Amendment. This is the kind of legal twisting which is now being made explicit (when before it was just an implicit assumption of left leaning officials) that is required to stop Trump. Hope it's worth it.
