"It's on it way up north on I-95," he said. "North on 95? Will you keep an eye on it and I'll call you back. Keep an open log on it. She is going to visit friends and will be gone a few days. Thanks for keeping an eye out for me, Nick." We hung up and I wondered why north. She should be going west, not north. I asked the kids again and they both said west to Charlotte was where she was going. We finished the shopping and went home. The kids went out to play with some of their friends so I called work to check where the car was now. Nick read me the log and she didn't stop in the city and hit the highway right away. If anyone got in the car they had to jump in it. He said she was on US 58 heading east so I told him to contact me when it stopped for good. He was leaving early but said he would stay later to help me out with this if I wanted him to so I told him if he would I would appreciate it. At four PM Nick told me the car was parked at the Naval Base in Newport News, Va. Son-of-a-bitch! She must be seeing Matt. She lied to me. I have to wait for her to call before I can do anything. She said she would call when she got there. At my car lot we have trackers installed in all cars. John found it cheaper than paying for the insurance we otherwise had to have on each vehicle. If one was out too long we would pick it up. Other times we called the cops to tell them where it was. This worked out so much better for us. I called her parents' house and talked to her younger sister since no one else was home. We gossiped for awhile and then I asked if anything was new with our naval hero, Matt. She went on to tell me today was his last day in the navy and he was retiring. She said they were having a big party for him at the naval base in Virginia. She gets a letter from him just about once a week. Well, I had all I wanted to know so I hung up and started to search the house. I didn't find anything except in the picture she had of us on her dresser. It was our wedding day. Behind the picture were my picture from college graduation and then five pictures of Matt. One was from high school and the rest with him in some sort of naval uniform pictures. What the hell was she keeping his damn pictures for? I didn't think she was corresponding with him but you never know. I then looked in the closet for the second time. I found a package with a receipt from the drug store dated for Monday, which was for a dozen rubbers. It had three left in the pack. She must have taken nine rubbers with her so she could get a lot of sex in over the weekend. I left his pictures and the package on the bed so she could see it all when she came home. A little after five I got a call from her. "Hi, Shelly, how was the trip? How'd the car run?" "Oh, it was great. It felt so nice having a new car to drive. All the girls say thanks and they want to thank you personally but I told them to keep their hands off you," she laughed. "You and the girls check in yet? I want the phone number in the room so I can call if anything comes up and leave you a message." "No, we are going to eat first and then check in. If you need me I got my cell phone with me so you can always get in touch with me. Okay, got to go. Will talk later." "Okay, call from your room so I can get the number and you can talk to the kids then. I like to know where you are staying in case of an accident or anything." "I've got my cell, dear. That is all you need to get a hold of me. You don't need my room number." "That's why they call them accidents, Shelly. If one happens to you I can go get your things from the hotel like car keys or whatever. So don't give me static; just do what I say." "Okay, bye, dear." She hung up. I knew I wasn't going to get the information I needed and I didn't care if I got it or not. I figured she was staying with Matt and with me giving her trouble now she would have to figure something out to satisfy me. Shelly called back at seven and talked with the kids. She gave the kids the phone number of a friend from the Charlotte area code that she was going to stay with instead of the hotel because they changed their minds and weren't staying in a hotel. She told them to give it to me. The kids where talking on the portable phone so they walked out of the room and when I got the phone they had already hung up. I called the number she gave me but no one answered it. I knew she was playing games with me. If she gave me a number from up there she was caught so now she had to drag someone else into it from the Charlotte area code. I didn't feel like embarrassing someone else so I didn't call it back until someone answered it but I did write the number down. The reason I didn't call back was I didn't want her to know I was on to her, I called her family and asked what they had planned for the weekend. They didn't have anything planned so I asked if they could watch the kids as I told them I had to go out of town to buy some cars. They have done this in the past so it was nothing new to them. The next morning I drove the kids there in the van and then went home and with the help of guys at work moved my stuff out of my house to a friend's garage till I got a place to stay. It was mainly clothes and my guns and some tools. I left a note on her bed that said the kids were at her parents and she could pick them up there. I knew she would see Matt's pictures and the packages of rubbers so I would let her figure it out what happen. It would be late on Sunday when she got home. She had to go to work on Monday and still make the ninety-mile drive to pick up the kids. Would she call in sick and do it the next day or would she drive there that night with her being all upset. I would just have to see. At eleven the house phone rang and I saw by the Caller ID it was her cell phone. She left a message saying she was busy and didn't know if she would call at night. She said she was having a lot of fun and enjoying herself with the girls. She never called back Saturday night but called again Sunday and left another message. "Hi, kids, I miss you all. I will be home late Sunday night so you kids go to bed and I'll see you before I go to work. I'm having so much fun; we are staying a little longer and will be home late Sunday night. Love you, Sam. Bye, you all. Love from mom, bye." I would love to hide in the closet when she comes home tonight so I could see what she does when she sees the pictures and the rubbers. I left her van on the street and had picked up another car from work to drive till she came back with my car. At work we saw my car heading back home and knew she was on the move; it was nine thirty. It would take her close to four hours to get home. When I saw her car on the move I turned my cell off and left it in the office and went over to the house. At eleven thirty she called the house and kept saying, "Hey, where are you guys? Someone answer the phone. I'm about two hours away from home right now. Answer the phone. Where is everyone?" She called again twenty minutes later and said the same thing. Except this time she said, "Sam, where are you? Why isn't your cell on? What if I had an accident?" I parked down the street in a driveway where I knew the people were at camp and I waited to make sure she got home all right. I saw her pulling in the driveway and all the lights were off in the house. She carried her bags out and got into the house. I saw other lights go on and then the kid's bedroom and she still couldn't find the kids. When I saw her bedroom light go on, I then left for my motel room. Let the bitch wonder what is happening after she sees the rubbers and pictures on the bed. Have fun, bitch. I played keep away with her for a week and then I took her calls. She chewed me out for moving out and not telling her why. I finally agreed to come over and talk to her after Sunday's dinner. I told her I wouldn't eat with her but I would come over after dinner and ask her to give me a time. She did. When I got there, they were almost done supper so I got a cup of coffee and waited till the talk would start. The two kids were all over me and glad that they could see me as they missed me. She was asking me questions but I gave her short and blunt answers. When she was finished with the dishes she sat with the kids and me and asked me just what the hell my problem was. "How was your trip," I asked her. "Good. I had a fine time with the girls," she said. I could see she was going to try to lie her way out of it. "Did you find your pictures on your bed when you come home?" "Yes, I did and if you asked me I could have told you I had them. Carol, would you run upstairs and bring down the picture of me and dad on our wedding day, please." Carol came down with the picture and lay it on the table. Shelly then took it apart showing the pictures of Matt behind our pictures. Shelly said, "Carol, you know who this guy is?" "Yes, Mom, isn't it Matt Upshaw, your first boyfriend you had sex with. When you gave me the lecture on the birds and the bees the last time, you showed him to me and told me how awful he was and he was just out for sex and to watch out for guys like him. You also told me to try to save myself till I got married." "Thank you, Carol. If you had just asked me, Sam, I would have told you I still had them. Now what else is your problem?" "Well, you didn't bring down the little package of twelve with only three left in the package that you took with you." "Women buy them all the time. We use them as gag gifts for baby and wedding showers. I also use it to protect my fingers at work when I have to sort a bunch of outgoing mail to be circulated." "Well, went did you buy them?" "Months ago I guess. I had them around for a long time, Sam. I told you I use them all the time. I don't know how many I bought since we been married but it is a lot." "Bob, would you go upstairs and under my pillow is a piece of paper. Bring it down, please." He went up and came down with the receipt from the drug store. I showed it to Shelly where she bought them last Monday. "Did you use nine since Monday? I don't remember you going to any showers that week and they have them on the weekend." "Well, I'm not sure when I bought them but if I didn't use them they are stored at work or in the house some place. If you didn't go off half cocked all the time there is a simple explanation to everything." "Isn't cock a nasty word, Mom?" asked Bob. I walked over, got her purse off the counter shelf, and spilled the contents on the kitchen table. One rubber was there out of the nine. Then I handed her cell phone. "That's four rubbers now we only need eight more to make a dozen. While you got your cell phone out why don't you give me a list of your last bunch of calls. Plus show me just who is in your speed dial section." She started to rattle them off and they all were to my cell. But when she got to last Sunday she said it was clear. I didn't believe her and asked to show me her speed numbers but she wouldn't. "This is a fifty-fifty marriage. You have to trust me and I don't have to show you everything. I've got some privacy rights, sweetheart, just like you have. What this all about? Just because I went away on the weekend by myself to relax you get all uptight?" I stood up as I said, "Okay, I'll get a print out of your cell for the last year of all the calls you made and then I will come back over and we can talk some more." Her face went pale and you could see tears starting to form. She got up from the table and left the room. I left a few minutes later after talking to the kids. They asked if we were getting a divorce like the rest of the kids in the neighborhood and I told them it sure looks like it. Monday I got the printout and took it to work to look it over. It had the whole year on it. I could see where she was talking to Matt a hell of a lot throughout the year. On her trip up to Newport News she talked to him on the way up. She also called the girl in Charlotte to arrange the cover call in case I called her there. She also talked to Matt on her drive home and as soon as she pulled in the driveway. She also called him an hour after she found the picture and rubbers on the bed. She has been calling or receiving phone calls at the rate of four a day since she has been talking to him. She called me on Tuesday and wanted to know when we could talk again. I told her I would call her Saturday and would send her over a package that I wanted her to look at and answer some of my questions and concerns. I told her I would have it dropped off in a day or two. I figured we could talk again Sunday and she asked me to dinner again. I said no and she said I was being hardheaded. We left it there. I had the list of cell phones calls sent to her. I also hi-lighted the ones I wanted her to answer to. I had Nick drop it off. I had told Nick and Tony, my two best guys, some of what happened between the two of us. They wanted to fly up to Matt's place and kick the shit out of him for me. I told them I would take care of that as I had plans for him and I would handle it myself. Friday I took the kids for the day to buy them some clothes and to enjoy their company. They told me Matt was in town and at the house. The kids told her mom that they didn't want him in the house so she had talked with him outside. They think their mom is meeting him at different times but they can't be sure about it. Bob said, "Mom doesn't want us around when you two talk on Sunday so we won't be there when you come over." Sunday when I got there I knocked on the door and she let me in, hugged me, and cried her eyes out. She continued to tell me how sorry and stupid she was to go there and see Matt. She was hyperventilating as she talked to me from crying so much. She was trying to tell me the whole thing was just friendship between the two of them. She stated there was never any sex between them since we had been married. She had never cheated on me one little bit. She talked for over an hour with me just saying, "Why?" every once in awhile. "So you actually want me to believe you drove four hours and spent two nights and three days with him and he didn't get in your pants after you went out and bought a dozen rubbers, and only have four left?" "No, I didn't have sex with him darling. I could never do something like that to you. I wouldn't be unfaithful to you. You have to believe me Sam. "Where did you stay then? You've got receipts for where you stayed?" "I made the mistake of staying with him at his place but we slept in separate beds. It sounds weird but you have to believe me." "I hear he is in town now. Why is that?" "I told him you were mad at me and he was afraid you would hurt me so he came here. I told him to leave as you would never hurt me." "Don't be too sure of that, sweetheart. Tell him he is the one who is going to get hurt." "No, Sam, I don't want you fighting with him about me. Nothing happened." "Oh, a guy fucks my wife for a whole weekend and you expect me to turn the other cheek? Just wait till I get a hold of his ass. He will be lucky he lives to see his first pension check." "No, Sam, I don't want you to get hurt because of me! I would never forgive myself if he hurt you bad." With that I walked out of the house. She sure thinks highly of me. Like I can't defend myself against some snake sucking wife fucker. I'll show her. I told Nick and Tony to check around car rentals and find what Matt was driving and where he was staying. I wanted this guy bad. It took them less than a day and I had the information I needed on Matt. My routine now was after work to go to a bar close to the apartment and shoot some pool. I would have a few drinks and eat there and at nine I would head to the apartment. I would watch some ball game on TV and then watch the news at eleven and then go to bed. I also was thinking what I could do to get that Matt bastard. In the morning when I got to work all the people asked if I seen the news. They told me that Matt Upshaw was killed last night. It seemed he was mugged or jumped and had the shit kicked out of him. By the time the EMT got there, he was pronounced dead. Wow, what a shock that was! I had to sit down for that. Damn, I wished I had something to do with it but I wouldn't have killed him. They said it happened at about eleven last night while I was in my room by myself. I got a call from Shelly who was crying and she asked me if I killed him and I told her no but was glad the asshole was dead. She kept pressing me if I killed him and I kept telling her no, I could never kill someone. I don't think she believed me but then I didn't care one way or the other. As the week went on we found more information about Matt. They said he was jumped or mugged by two guys. They punched and kicked him and from the autopsy a broken rib poked into his heart and he died. I really felt sorry for him. He would have been better off just taking a beating from me. I would have worked his knees so he would remember me every step he took but good riddance to him. Some witness saw two men running away but gave no description of them except they where guys. Three weeks went by before the cops came around to me to ask questions. First thing out of me was, "Go talk to my lawyer. I've seen too many TV shows where they get you down there and you confess whether guilty or not." A few days later I went down and wrote a statement or where I was that night he got killed. Of course I was alone and no one saw me. Nick and Tony said I should have said I was with them to protect myself. After a few more weeks went by, I found out the naval criminal investigators were in on the case working with the local police. I was hoping there was some DNA left at the scene to get me off the hook but then I really didn't want them to find the guy that did it. Well, Christmas time rolled around and the police came with a warrant and arrested me for the second-degree murder of Matt Upshaw. What a shock to my system! Me in jail for something I didn't do. My lawyer turned the case over to one of his friends who is a high priced criminal defense lawyer. He got me bailed out for a hundred thousand-dollar bond. The charges were murder in the second degree. I was never scared before until all this shit happened to me. I was still married to Shelly but not living with her. Plus I bet she still thinks I killed her lover. We spent Christmas day at our house opening presents but the mood was down with all the things hanging over my head. I told my son not to worry about it, as I didn't do it so it was a no sweat situation. Two weeks later I met with my lawyer and he told me they just had circumstantial evidence against me. The only thing they had on me was shooting off my mouth at work and at the bar saying I would get the guy. Any normal guy would say that if someone were fucking his wife. They couldn't put me at the scene but I couldn't prove I was home either. Shelly's statement is she didn't have sex with him. But they had plenty of witnesses saying they think she did and she spent two nights and three days with him at his place. My lawyer is claiming the EMTs killed Matt giving him CPR and that it wasn't from the kick. They broke a rib, which punctured his heart, which happens a lot giving CPR. Plus he would have a doctor in the court to testify to that, which was going to cost me a bundle to have him testifying. Over the next six months the prosecutor wanted to make some deals. The way it stood I could get twenty-five years. He was willing to reduce it to manslaughter and I would get seven and a half to fifteen years. Damn, all this scared the shit right out of me. How the hell does an innocent man get to do this kind of time when he didn't do it? I couldn't make a deal and my lawyer said I should get off, as they didn't have that much against me. Well, we went to trial and the prosecutor marched witness after witness testifying about the love affair my wife had. He tracked her all the way using our program at work saying we followed her steps all the way just like they were doing. We brought Shelly to the stand denying all of the sex stuff. We had our doctor on too, for all the good it did.
