Their editing and suggestions mean a lot to me and make my stories a much better read. * Awhile back I wrote a story about CSI, (Crime Scene Investigators) Jim Lee and Bobbie (Roberta) Burke. The story was Titled: Who Did It? At the time Jim and Bobbie were just working buddies. Now they are more than a team; they are in a relationship. Neither is ready to commit to marriage or to even living together. They continue to date and have sex once in a while to rid themselves of their tensions. This narrative begins with Jim telling the story. We were ridding ourselves of frustrations and tension one evening and, as we were both in the throes of passion, my cell phone started ringing. I said, "It can wait, I can't stop now, Bobbie. I'm about to cum." My phone stopped ringing and Bobbie's started. "Not on your life, whoever is calling. We tried to keep our personal and work life separate, but weren't doing the best job of it. Just so the readers know: CSI's in this part of Ohio were officers who worked for the Sheriff's Department. They attended special classes to become investigators. They were also loaned out to neighboring counties when necessary. About eighty percent of their time they were on investigations. The other twenty per cent, they were Sheriff's deputies. Bobbie was the first to show up at the scene. I should say that she was the first CSI to show up. Police officers were already there, protecting the evidence. Bobbie took a quick look at the dead victim and then the ambulance removed him from the scene. A few minutes later I showed up and asked Bobbie what she found. "Jim, the victim is a man around sixty who apparently drowned in his new hot tub. If you would like to go inside and talk to his wife, she found him in the tub. I'll see if there is any evidence in or around the tub." "Sounds good to me. I'll talk with the wife and maybe we better talk to a few neighbors and see if anyone heard or saw anything." We agreed to meet back at the scene of the apparent drowning. I talked with Mrs. Moore about finding her husband's body. She said that he was getting ready to get in their new hot tub, as she was leaving to go shopping. They only had it about three months. When she got home a few hours later she found him under the water. She tried to pull him up but he was much too heavy. She did manage to get his head above water but he was already dead. She ran in the house and called 911. I asked her if I might be able to look around a little. It was just procedure. She said it was alright as I got up and strolled into the bathroom. I always checked for prescription drugs. It was a force of habit. I did find a number of bottles of different drugs in the medicine cabinet but most had Mrs. Moore's name on them. I jotted down all the info in my note pad. I told Mrs. Moore that we needed to close off their patio for a couple of hours and go over any evidence that we might find. She asked me why we were doing all this for a drowning. I explained to her that until an autopsy was done, the cause of death wouldn't be determined. It was just the regulations of the system. She wasn't overly happy about us being around but said she understood we had a job to do. About that time one of her daughters arrived and asked if it was alright for her mother to go home with her. I told her it would be a really good idea. We would lock up the premises when we were finished. After looking around the house a little more, I didn't find anything out of the ordinary. I then went and talked to a number of neighbors on the Moore's right side. After gathering evidence, Bobbie talked to a few neighbors on the Moore's left. About a half hour later, we met back on the patio to discuss our findings. Bobbie was busy swishing her hand around in the water. "I'd love to get in a hot tub and relax," said Bobbie smiling at me. "Would that be naked or with clothes on?" I smiled. "By the way, was our victim naked or have a bathing suit on?" "He was naked and before you ask, yes, it was pretty shriveled up from being in the pool so long." We have been on so many crime scenes together that we did joke a little. We weren't being inconsiderate. We knew a man was dead and we took that part very seriously. "I know we're not supposed to draw conclusions but what do you think so far? It does look like a drowning," I said. Bobbie gave a first impression. "He undressed right here on the patio. He was naked. Doesn't look like foul play but we'll have to wait for the autopsy to come back. I have a couple of doubts. When I gathered his clothes, there were stains on his underwear. It looked like he had sex recently. I also noticed a couple of scratches on his back which looked like they were caused by fingernails. I took some samples of the water but any evidence there would probably be pretty filtered out. It looks like an accidental drowning but I have this gut feeling. I did find a ton of fingerprints all over the spa. I took samples of some that looked recent. I don't know if it will be of any help or not. I need to see the autopsy report. What did the wife have to say to you?" Bobbie asked, as she finished taking notes. I replied, "She told me that she was getting ready to go shopping when her husband came home from one of the neighbors. He had gone over to borrow a movie to watch this evening. Apparently the Smith family has a lot of movies. She said he was going to go in the hot tub and relax for a while before watching the movie. She told me she was gone about three hours or so and when she got back he was in the hot tub. His head was underwater and she was only able to pull his head out of the water, but he was already dead. She called 911 then her daughter. She was a little shook up but still had her senses about her. I would have thought she would have been a little more shaken, but everyone grieves their own way. They had just celebrated their fortieth wedding anniversary last month. "I also talked to a number of the neighbors. They all said about the same thing, Mr. Moore was a nice guy. Most said that Edna, Mrs. Moore, ran a pretty tight ship. She is a nice woman and looked a lot younger than her sixty-two years of age. She belonged to the church women's groups and helped out at the school as an aide. Mr. Moore, or Wayne as they called him, retired early about four years ago. He helped a lot of the neighbors doing odd jobs for them," I said. Bobbie asked me, "Did any of the women say he flirted with them?" "No, they said he was kind of a happy guy and would say little flirty things but his wife was present or their husbands were there. No one ever said he made a pass at them. Of course I never asked any questions quite like that. Not every woman would tell you even if he did. Some would do the opposite and say he did even if he didn't; everyone seems to have a different opinion on the flirting issue. He seemed to be well liked. I guess the Moores have lived here over thirty-five years," I answered. "What did you find out?" "I talked to the Smith woman and her husband, Carly and Bob Smith. They moved here last year. This is a pretty nice settled neighborhood. Most of the families are older, near retirement age but there are a few young couples. The Smith's are one of the younger ones, probably in their late thirties. Mrs. Smith was shocked to hear of Wayne's - Mr. Moore's - death. "She started crying and said that he had stopped by earlier that afternoon to borrow a movie. One thing that bothered me was she said he borrowed the television series 'Mash', but I noticed it was on their counter when I left. I thought that was rather odd. I mentioned it to her and she hesitated and then told me that he had brought that one back and borrowed the second season. When I was looking around at the Moore's home, I never saw the movie, did you?" Bobbie asked me. "No, I didn't see any disks whatsoever lying out. Well, that's about all we can do for now until we get the autopsy report back and some tests run on his clothing and the two beer bottles and the glass you found at the hot tub." Bobbie kept looking in the hot tub. I knew she would have loved to get in one and feel those hot jets caress her body. I promised her that maybe after we got through with this case we could go to a motel that had a hot tub and she could lay in it as long as she wanted. It got me a big smile back from Bobbie. We took all our evidence back to the precinct and started on our tests. Crime was rather light in our area, at the moment, so we had to run most of our own tests. This looked like it would be pretty much a case of accidental drowning. We still went through all the motions until we had answers to most of our questions and our doubts. I ran the test on his underwear and other clothing. Bobbie checked for fingerprints on the bottles and glass that were at the scene, and also the water sample from the tub. She was able to get about four distinct fingerprints off the tub. We'd have to try and match them up with someone. There definitely were cum stains on his underwear. There was also a woman's secretions which must have transferred from his privates on to his Jockey shorts. We knew now that he had sexual relations shortly before his death. We also found strands of brunette hair on his clothing. I remembered his wife was in her sixties and wore a blond wig. More than likely she had grey hair under it. We probably would have to ask her about it. Bobbie said that Mrs. Smith had brunette hair. It looked like we might have to re-interview her again. Bobbie also found traces of a medication in his beer glass. We would have to match it against his stomach contents when we got the report from the autopsy. The beer bottles had his fingerprints and another set of prints on them. There were others but we figured they were so smudged that it was just the handling of the bottles through the stores stages of selling. The two sets of prints stood out. We knew the one set belonged to the victim. We needed to see if the other set belonged to Mrs. Moore. Bobbie was shaking her head and making an odd face. "What is it, Bobbie? Did you find something?" "I sure did. Remember I was swishing my hand around in the spa? Well, it seems that the water sample has urine in it. Mr. Moore must have urinated in it, and I was swishing my hand around in the water. It was just a gross thought," she said. -------------------------- The next day we went to see the doc about the autopsy. He was nearly finished with it. He did have a lot of information for us. Mr. Moore died from water getting into his lungs. Basically he did drown. The doc said that he had a sleeping medication in his system. It wasn't necessarily an overdose but was more than the one tablet which most doctors would have prescribed, could have been anywhere from two to five of them. Of course they were crushed and some of it was dissolved. I pulled out my list of medications that I wrote down from the Moore's bathroom cabinet and one of them matched the medication found in his system. It was his own medication, only he had taken more than one. The Doc said it would have been enough to put him to sleep. The only problem was that he had the water in his lungs. He had to struggle to try and get up before swallowing so much water. The doc said as pure speculation he was either held down with his head underwater or he was so disoriented that he just swallowed too much water before being able to recover. We told the doc about the urine in the water. He kind of laughed and said either he was too lazy to get out or he pissed while struggling to get out. The doc said as far as having sex, he could have. Any traces of semen were long gone due to the hot tub, but he didn't have any reserve built up in his system. So if he shot his load it was long gone. The scratches on his back were definitely made by fingernails. The doc was pretty sure of that. The information didn't tell us much more than we already figured out. We would have to talk with the wife again and also Mrs. Smith. I suggested to Bobbie that she talk with Mrs. Smith and I would talk with the wife again. I called ahead and let Mrs. Moore know I was coming. After all, we just needed more information right now. When I got there she acted very nice. She began telling me about their life together and how they celebrated their fortieth wedding anniversary. She poured me a cup of coffee and continued telling me about her four children who were all in their thirties by now. She had eight grandchildren with six of them visiting her regularly. She seemed to be a strong willed woman and would probably be alright. After listening to her for about a half hour, I told her I had some questions I needed to ask her. Some would be personal but I would do my best to keep my questions at a minimum. After she said she understood, I started asking her some questions. "Mrs. Moore, did you give or do you know if your husband took any medication before you went shopping?" "Why, yes, he asked me for one of his little green pills. He said they relaxed him." "Are you sure you only gave him one? They found the contents of more than one in his system," I said. "No, I crushed up one for him in his glass and I poured beer into it just like he asked me to do. You don't think he went and got more and took them, do you?" she asked. "He was always so forgetful." "Did he get in the hot tub before you left to go shopping, Mrs. Moore?" "No, he was just walking around the house. I poured his beer and set it on the counter before I left. I kissed him goodbye and told him I'd see him later." She was beginning to cry. I reached over and handed her a couple of tissues. "Mrs. Moore, have you and Mr. Moore had sexual relations recently? I'm sorry I have to ask but he did have semen stains on his underwear." She gave me kind of an odd look as I left and went back to my office to fill out my reports. I knew that Bobbie was talking to Mrs. Smith. It would be interesting to see what she had to say. ----------------------------- Bobbie came back to the office. She was shaking her head. "Boy, do I have a story for you," she said. Then she proceeded to tell me about her talk with Mrs. Smith. "To begin with, I knocked on Mrs. Smith's door. She came to it and when she saw me she put her hands over her mouth and started crying. " 'I didn't mean for it to happen; it just did.' " 'What just happened, Mrs. Smith? Do you know something about the death of Mr. Moore?' I asked. " 'My God, no, you said it was a drowning. I've never even seen his spa yet. I thought you came back to ask me what happened. I figured you had found out that I had sex with Wayne.' " 'Yes, we did. We knew that Wayne had sex before getting in the spa. We figured you might be able to shed some light on the subject. May I come in and you can explain exactly what happened.' " 'Please come in. We still had some of the fingerprint information to come back but we'd already matched up most of them. There wasn't much more information to come in. Bobbie and I were pretty sure of foul play but we really didn't have enough proof. We felt that Edna knew more than she was saying. Mrs. Smith's story and Edna's didn't agree, so we knew one of them was lying but we weren't sure which one it was. The District Attorney came into our office and said that Mrs. Moore's attorney had called and wanted to know what was going on. She wanted her husband's body released for burial. He asked us what kind of information we gathered and about the cause of death. We told him the cause of death was drowning but we weren't sure it was an accident. We explained about how the wife had told us about his medication and she was the same one who discovered the body of her husband and called 911. We believed she found out about his affair and did him in. "Well, Jim, and Bobbie, all we have is the information you two gathered. There isn't enough here for me to have a sixty-two year old grandmother arrested and accused of murder. I agree that some of the statements are contradictory, but I would look like a fool taking this case to court. I'll have the body released today and I'll leave the case open for a couple of more days. Let me know if you find out anything more," said the DA. I looked at Bobbie and asked her opinion. She thought the old lady did her husband in too. We didn't have enough for a conviction. We weren't able to rule out either Mr. and Mrs. Smith either. We both felt that Edna found out her husband's infidelity and reacted to it by overdosing him with his drugs and then holding him under water in the spa till he stopped kicking. We decided to go to the funeral and see if we could find out anything else. It wasn't unusual for us to attend funerals of victims. We didn't bother anyone and did pay our respects to the deceased. Some of the neighbors even came up to us and talked about the couple. We had met many of them when we did our interviews during the initial investigation. One elderly couple came up and introduced themselves. They were Mr. and Mrs. Able. They lived across the street from the Moores. They were gone when we did our investigation the first day. "He was such a funny man," replied Mr. Able. "I've know him for almost thirty-five years. He was a good guy but he liked the women a little. He got caught twice and Edna about did him in." "When was this, Mr. Able?" I asked. "Many years ago. The last time was probably ten years ago. He and Edna just stayed together after that. She never trusted him from that point on. "No, we were just sitting out on our porch swing. No one went to the house. Wait a minute. As we were leaving and as we passed the Smith house, we saw Bob Smith was walking toward their house. It was odd because he was walking along the back side of the house instead of in the front. We waved to him but he never noticed us. He might have gone there although we only saw him walking through his backyard, but toward the Moore house." "Are you sure it was Mr. Smith?" "Yes, he's a decent guy but a little headstrong. He seems to yell at his wife and kids a lot. It must just be this generation. Just too much stress. Mary and me are eighty-two years old and married nearly sixty years. These kids today will never make it." "Well, thank you for the information, Mr. Able." "Detective, Wayne did drown, didn't he?" Mr. Able asked, wondering about foul play. I answered him honestly, "Yes, he died of drowning." I didn't tell him we were wondering if he had help. We watched as Carly and Bob Smith came in to pay their respects. Carly was shaking as they walked up to the casket. As Bob was talking to one of Wayne's sons, Edna stepped up and whispered something into Carly's ear. She started crying as she and Edna hugged. I sure would like to know what was said. Carly went to the ladies' room and Bobbie followed her. She was going to ask her what Edna had said to her. When Bobbie came out, she had a slight smile on her face. "Okay," I asked. "Are you going to tell me what was said?" "Let's take a walk outside for a few minutes. You're going to want to hear this without any listeners." We stepped into the parking lot and Bobbie told me what Edna said to Carly. She told her that she knew that she had an affair with her husband. Since she was a Christian woman and that they had to live in the same neighborhood they wouldn't be friends but they could be civil to one another. She could explain to her God about the affair when the time came. After the funeral, Bobbie and I went back to the lab. We still had a few fingerprint samples to run. On the beer bottles it was basically Edna and Wayne's prints. The Jockey shorts had Wayne's prints and another set which we believed to be Carly's which wasn't a surprise. After all, she told Bobbie she handled his member and would have touched his shorts. There were four sets of prints that Bobbie got off the spa. Wayne's, Edna's, a child which we figured was one of the grandchildren and an unknown set. Bobbie pointed out that the set of prints on the shorts matched the set on the spa. "What's the matter, Bobbie? You found something, didn't you, other than pee in the spa." I just tried to add a little humor. "We figured the prints on the shorts are probably Carly's. They match the unknown set of prints on the spa. Carly said in her statement that she has never seen the spa yet. How can that be if her prints are on it?" We knew we had to get Carly's fingerprints. Bobbie ran Carly's and Bob's name through the data bank. We wondered why they had moved here from Kentucky. The data bank would tell us about any tickets or arrests. It was a long shot but we needed to start closing a few of these windows. Things seemed to be improving. We got a call from the coroner who did the autopsy. He told us as he was reading his report that he noted that he had found a slight bruising on the right shoulder of Wayne Moore. That could mean someone held him down. Of course it was still speculation. I asked the coroner if a woman could have left the mark. He told me it was a bruise and, yes, most anyone could have held a man down in the spa if he was asleep to begin with. The information did lean in the direction that someone might have killed the deceased. We received a report back on the Smith family. We decided we would call Edna and the Smith's in and have another talk with them. None of them seemed happy about it but we told them if they didn't come in that we would send a patrol car after them. Edna and her daughter showed up first. We took them into one of our rooms to talk to them. We had the DA sit behind the two way mirror while Bobbie and I sat at the table with Edna and her daughter. Edna asked if her daughter could stay with her. We didn't see any reason why not, so we let her stay. Mary, Edna's daughter, asked why she had to bring her mother down here. She thought her mother been through enough. Edna stopped her, "Mary, they are investigating your dad's death. They believe that he was murdered, and I'm a suspect." "What? How stupid! Mom would never do such a thing..." Edna interrupted her. "Mary, they are just trying to do their job. Please let them do it. Okay, officers, ask away," said Edna. "Mrs. Moore, we do believe there was foul play but we don't have enough evidence right now." "Listen, officer, everything I have told you is the truth. I did not have anything to do with my husband's death. I'll tell you some things that I'm not proud of because I don't like waving the family garbage. As you already know, Wayne and I were married for over forty years. In that time he had cheated on me a number of times. I always turned my back for the sake of the children." I asked Edna if she would like Mary to step out before she finished her story. "No, my kids know about their father. Over all, he was a good man. It's just that he liked the women. The last time he had an affair was about ten years ago. I told him that I had had enough. If he had another, affair I would leave him and take everything we owned. After that, we had separate bedrooms. We did a lot of things together but sleeping together wasn't one of them. As far as I know he tried to be faithful after that. Of course that was till the Smith's moved in. He was smitten by Carly. I could see it in his face. "One time he said that she reminded him of a young me. He meant it as a compliment but of course I didn't see it that way. He would go over constantly and help Bob do things. I think he just wanted to be near Carly. I knew when he came home that day that he had sex with her. I could see it in his face and then I saw the scratches on his back. I wasn't sure what to do. I called my other daughter and decided to go shopping. I had to get away from there before I did something stupid. I'm over sixty years old, where could I go? Where would my finances come from? "Everything I told you earlier was true. I did only give him one pill. He was in the bathroom when I left. I did call 911 when I got home. I tried to pull him up out of the water. You see, after all these years I still love the old bastard." She began to cry, and so did her daughter Mary. I handed them a box of tissues. She continued, "There are only two things I didn't tell you that day. One - I called Bob Smith's office and tried to disguise my voice. I told him he ought to learn how to take care of his wife. I guess it was my way of getting even. The second is Carly called here and I told her Wayne was in the tub already. I asked her where the movie was he supposedly got. She told me he forgot it and she would drop it off later. I asked her why he was gone so long. I wanted to hear her lie. She said he was fixing a plumbing problem. I guess that wasn't too far from the truth. "There's nothing else I can tell you. I both loved and hated Wayne. You feel that way about a person after forty-plus years. I promise you, with God as my witness that I did not harm him in any way." "Why didn't you tell us all of this in the beginning?" I asked. "I don't know. Mad, aggravated, sad, maybe even a little afraid that someone would think I could even do such a thing. I'm so sorry, I really am. If it wasn't an accident, I hope you find out whoever did it and why." "Thank you for coming in, Mrs. Moore. We will try and get this case closed as soon as possible," I said. ---------------------- We saw Mr. and Mrs. Smith come into the building. We asked them both to come with us and placed them into separate rooms. Bobbie and I both went into the room with Carly. Bobbie was going to do the talking since she had talked to her previously. First Bobbie read Carly her rights. We wanted to make sure that she knew that they could have an attorney present. She said she didn't have anything to hide. "Why am I here? I've told you all I know. I told you about the affair and everything. What do you want from me?" We could tell she was extremely nervous. "Bob wanted to know if I did something wrong since you called us both down here. You told me he would never find out." "Mrs. Smith, we have been reviewing your statements and have a few questions for you. But, first we have a few questions about your past," replied Bobbie. "My past? What about my past? What does that have to do with anything?" "Carly, we were wondering why you and your family left Kentucky. It's no use lying to us; we had your information forwarded to us. According to the report your husband was charged with Assault and Battery, is that correct?" "Yes, he was found innocent. He was just protecting me. Brett was going to rape me and Bob stopped him. Bob was found innocent." "Let's see, according to the report, you were at your school reunion and you and Bob went to your room. You weren't sleepy and decided to go down into the game and weight room and go in the spa. Is that correct so far?" "Yes, but what are you getting at?" "Just bear with us. We are looking at your report," said Bobbie. "Apparently your old boyfriend happened to be there also, and started to make a pass at you." "He was going to rape me. We were sitting in the spa and he put his hands on me. I told him, 'No' over and over but he was overpowering me. He kept trying to kiss me and he had his hand inside my swimsuit bottom and was trying to finger me. I was lucky that Bob showed up and grabbed Brett and beat him up. Brett was taken to the hospital and they arrested Bob for assault. The judge threw the case out." "Carly, why did you wait to file attempted rape charges? According to the investigation you didn't file charges against Brett till the DA had assault charges filed against Bob." CSI: The Hot Tub "I wasn't sure what to do. Bob told me I should file the charges against Brett to help his case. It's the reason that he assaulted Brett, because he was trying to rape me." "According to the court documents, you both decided to drop your charges if the whole mess would just go away. Is that true?" "Yes, our attorney said that Brett was willing to drop the assault charges against Bob if I would drop the attempted rape charge against him." "Is that part of the reason you moved to Ohio, to leave the mess behind?" "Bob was offered a job here with a nice raise in salary. We thought this would be a great place to raise our family. We love it here." "Does Bob get jealous of you or does he get mad when other men look at you?" "I don't quite know how to answer that. I love Bob and he loves me. He takes a medication for stress. If he forgets to take them or drinks alcohol, he gets loud or aggravated. He's been really good about taking his medication for quite a while now. He's always under a lot of stress." "Carly, about the day you were with Wayne." "I already told you everything. I'm not going to sit here and repeat it on a tape recorder." "Carly, we just need some clarification and also your fingerprints." "Fingerprints? For what? I told you he was there for Christ's sake." She was aggravated but let us take her fingerprints. We sent them out immediately to have them compared to our samples. Carly asked for something to drink so we had a beverage brought in. In a few minutes the sample was returned. The unknown prints belonged to Carly. Bobbie looked at Carly and said, "You lied to me. You told me that you had never seen the Moore's spa but your fingerprints are on them. How could that be? You were there, weren't you? You were there the night that Wayne Moore died. Admit it, we have the proof, admit it, you were there." "Yes, yes, I was there. As soon as my oldest kids got home, I walked over and put the movie he wanted on their table. I then went out and looked at the spa. Wayne was already sleeping. I guess I put my hand on the spa while looking at it. I only stayed a couple of minutes. I had to get home and take the kids to a school function. Honest, I was only there for a minute. Wayne was very much alive when I left, just sleeping. I didn't want to wake him; I had to get back to my kids." "Why did you hide this information from us? How did you get there?" "After you said he was dead, I didn't come forward. What difference would it have made? I just dropped off the tape, that's all. I cut through our back yard. It's shorter and no-one would see me." "Tell me, Carly, how did the tape get back to your house? When we came and talked to you it was sitting on your counter." "I didn't know at the time but I think Bob must have brought it back. When we came back from the school function, Bob was home and so was the tape. I figured he went over to see Wayne and brought it back. I didn't want to say anything and talk about Wayne to Bob, so I kept quiet. Later when you guys came by, I figured Bob would have told you guys if he was there, so I didn't. I sure didn't want to make any waves." "Does Bob know about you and Wayne, Carly?" "God, no! He's been a wonderful husband since Wayne's death. He's been spending more time with me and the kids. That's why I didn't want to come down here. I don't want him to find out. Bob is very protective of me and would do most anything to protect me. I made a mistake with Wayne and didn't want Bob to find out." "That's all we have for you, Carly. Thanks for talking to us. If you can think of anything else, please let us know." Now it was time to talk to Bob. At first we excluded him as a suspect since he wasn't around during the day. After we checked with the coroner, he figured the time of death to be between 3:30 p.m. and 6:30 p.m. So now we needed to talk to Bob. I was going to do this interview and Bobbie would be at my side. The DA was still listening in. As we walked into the room, Bob stood up and said, "What the hell's going on? What do you want with me and Carly?" "Please sit down, Bob, or we will have to cuff you to the chair. We will give you your rights and you can have an attorney present if you would like." "What's going on, I got nothing to hide. I work for a living. I pay your wages." "Easy now, Bob. We just have a few questions for you. Is it true that you moved here to get away from some troubles you had in Kentucky?" "Man, that's old news. He was trying to rape my wife and I took care of business. He was coming onto Carly all night and then, when she went to the spa, he followed her. They dropped the charges; all I did was protect my wife." "You put the man in the hospital for two weeks. You nearly beat him to death." "Every upstanding husband would have done the same thing. If a man messes with my wife, he's going to pay the price." "Did Wayne Moore ever come on to Carly?" I asked. "What do you mean? He was just an old fuck who thought Carly was a pretty woman." "The day he died, didn't you get a call, something about taking care of your wife? According to your caller ID, you called the house. Did Carly answer it or was something happening at the time?" "How do you know that?" "It's our job to find information. Did you get mad all day wondering what your wife was doing? We know you came home and your wife wasn't there." We could see him starting to get mad and he jumped out of his seat. Two uniformed officers came in and cuffed him back down to his chair. He was beginning to fume. I continued, "We know that when you got home, you headed over to the Moore's house to confront Wayne. Did their phone number show up on the caller ID at work? We have eye witnesses who saw you going there. We also know that you took your, 'Mash', tape back home so no-one would know that Carly was there. I bet you were fuming looking at Wayne lying there naked after doing your wife. I bet it really got to you. Tell me Bob, what did you do? What did you do?" "That dirty old cock sucker. He's wanted my wife ever since he first saw her. He went to my house and probably tried to molest her. I'm guessing he tried to have sex with her and then came home and got in his damn hot tub. I couldn't take it seeing him sleeping there with a grin on his face, lying naked in the tub. "It was so easy; I just put one hand on his shoulder and the other on his head and just pushed down. I just wanted to scare him. I wanted him to wake up and I was going to beat the shit out of him. He started kicking and eventually I let go and he just stayed there, under the water. I got a little nervous and saw our tape on the table and grabbed it and went back home. I changed my shirt and waited for my family to come home." "Does Carly know what you did?" "No, I did it to protect her. That old man probably tried to have sex with her and I know she was afraid to tell me, so I took care of business. You guys came by to talk to us about an hour or so later." "Bob, we are going to have to arrest you and charge you with murder. We will read you your rights again since you are being charged." "It's okay. He got what he deserved; I did it to protect my wife. The old man tried to rape her and, when she tells the judge, he will let me go again, just like last time. All I was doing was protecting my wife." ----------------------- We went out and broke the news to Carly. She started crying and asked to see Bob. We told her he was being booked and she should go home and come back tomorrow. Bobbie did ask her if she had any idea that Bob killed Wayne and she said she knew he was capable but was hoping he didn't do it. She hoped that Wayne's death was an accident. It was the reason she didn't want Bob to find out about her affair. She said she knew he couldn't handle it well. The DA came out to talk to Bobbie and me. "Wow, that was quite unbelievable. Of course he will be charged with murder. His wife can't claim rape like she said she did the last time. Bobbie got her statement the other day saying she was a willing participant. Let me tell you two something I find quite odd. Edna Moore could have been charged with the evidence you two found. It would have been a really rough case due to the type of evidence. It's why I wasn't going forward with a charge against her. The jury would have been against us as he was a cheating husband and there were no witnesses. "We also could have charged Carly Smith and made a case there also. The idea of her coming back and we would have believed she was the last one to see Wayne Moore alive, other than if it was Edna. It would have been a hard case to prove also but the evidence showed she was there and that she lied. It would have been two things in our favor. "Now, let's look at Bob Smith. If he wouldn't have admitted to it, we didn't have enough evidence to prove him guilty. No fingerprints, no evidence against him other than what he told us. After he admitted to it, it pretty much closes the case. I want to congratulate you two on another job well done. I know it's not easy dealing with crime every day." We thanked the DA and went to finish our reports. In the days that followed, charges were brought against Bob Smith for second degree murder. The DA said by Bob's own testimony was that he was intending to beat Wayne up, not kill him. He thought that eventually the lawyers for the defense would ask for the charges to be reduced to manslaughter or have Bob plead temporary insanity. It would probably be a month or more before the case would be brought to trial. Bobbie and I were now working on separate cases. We weren't together everyday and I kind of missed that. I was thinking about her often and it always bothered me when I heard other guys saying how they would like to get in her pants or similar things. It was pretty much guy talk but we never said it in front of a guy's girl or wife. Most didn't know she was my girlfriend or they wouldn't have said anything in front of me. I corrected them a few times and they told me to chill; they liked Bobbie as a friend too. They told me that they just thought she was a fine looking woman and I was lucky to have her as a partner. Bill, one of the guys that knew I had a crush on Bobbie asked me why didn't I ask her out and to be my girlfriend. Maybe then the guys would lay off the talk. I had to admit I was really falling for her but we both agreed on no commitment right now. I talked to her a few times but our schedules didn't allow us much time to get together. I often wondered if she missed me as much as I missed her. I thought that we better start discussing our feelings. I was hoping it was a two way street. I rode through the Moore's and Smith's neighborhood one day and saw The Able's sitting on their porch swing. Mrs. Moore was sitting on a chair talking to them. They all waved to me as I rode by. As I passed the Smith's house, I noticed the kids playing in the yard. It made me think how it's always the kids, the innocent ones that suffer for their parents' wrong doings. I saw a 'For Sale' sign in the yard. I guess Carly either couldn't afford the property anymore or couldn't take the abuse she and her kids must be getting. It was a sad situation, but that's what my job was all about, finding the bad in people, or at least collecting the evidence to help find the wrongdoers. I would never be out of a job. I was heading home when I my cell phone started ringing. It was Bobbie. "Hi, Jim. Are you busy?" she asked. "I'm never too busy to talk to you, Bobbie. What do you need?" "I could use some help on this case I'm on. I want to try and get it done tonight but I can't have it done by myself. Do you have the time to come by and help me?" "Sure, I was just headed home. Where exactly are you?" I asked. "Right now I'm at the Ramada Inn on Hayward Blvd. Just go to the desk and tell them you're Detective Jim Lee and they will give you the key to room one-twelve. It's on the first floor. I have to keep the door closed to preserve the evidence." "Okay, I'll be there in about ten minutes. See you then?" "Thanks, Jim. Please hurry. We have a lot to accomplish if we are to finish tonight. Bye." I drove over to the Ramada Inn and headed up to the desk clerk. "I'm Detective Jim Lee, I'm suppose to meet..." "Yes, sir, here's your key. Room 112 right around the corner. Have a good evening," he said. I thought, "A good Evening?" He sure doesn't know much about our job. The only thing good was that I was going to see Bobbie. I headed to Room 112 and slipped the key into the door and opened it. I looked up and I saw a platform with a hot tub on it and inside the spa was Bobbie grinning at me. "It's about time you got here; I was afraid I would turn into a raisin before you got here. Hurry up and get in, the water feels great and lots of bubbles." "I thought you had a case you wanted to finish before morning?" "There is! I have a case of twelve wine coolers to finish by morning and with your help, I think we can do it. Bring us both one and get in the tub." "Are you naked in there?" I asked. "Come on in and find out. After all, the room is in your name and you might as well get your money's worth." "My name? You put the room in my name." "You promised me that you would take me to a spa after our last case. I'm just holding you to your promise. Now get naked and get in here with me." She smiled. I stripped and climbed into the hot tub. I laid and just felt the bubbles and jets hit my body. It felt so relaxing. Bobbie was smiling at me so I asked her, "Why are you smiling? You didn't pee in the tub, did you?" and I smiled back at her. She came over to me and started rubbing my chest. I pulled her to me and kissed her. I pulled her nude body to me and kept kissing her. "What is it, Jim? Why the deep kiss? Is something bothering you?" "I want you to be my girlfriend. I know you don't want a commitment right now, but I do. I want to tell all the guys that you're my girl. There I said it." "Your girlfriend? Is this kind of a guy thing? I looked over at Bobbie and thought about what a wonderful person she was and that I would do anything for her. My mind started to wander and I started to think about the Smiths, Carly and Bob. "What are you thinking about, Honey?" asked Bobbie as she looked over at me. "I'm thinking about how I feel about you and how I would do anything for you and then I thought about the Smiths." Bobbie looked over at me as we were feeling the hotness of the spa. "The Smiths? What about them?" "I know this is pure speculation and we have no legal proof, but I was thinking what if Bob went over to see Wayne to argue with him, but when he got there he was already dead. He looks on the table and sees his movie. He thinks that Carly must have killed Wayne for him trying to molest her. So, he takes the tape to hide the fact that Carly was there. I wonder if he loved her enough to take the rap for her." "Well Jim, you could go one step further and, even though he thought Carly killed Wayne, just maybe Edna did it but of course Bob wouldn't have known it," said Bobbie. "You're right; all we can do is our job to the best of our ability. It's why we have a legal system. It's up to the judge and jury to make what they feel is the right decision. Bobbie, did I tell you I love you?" "Yes, you did and I told you I love you too." "Bobbie, can we lay here in this spa and go over that case some more? There is something out of sync, I need to find it. Would you just mention things and I listen to you?" "What brought all this on about the Smiths, Jim?" "I got a call from the DA today. Bob wants to change his plea to not guilty." "It happens all the time. Jim, suspects always change their pleas. Why is this so different to you? "The DA said that Carly told Bob about her affair with Wayne. She couldn't hold it in any longer. She also told him she didn't kill Wayne. Bob told the DA that he admitted to the murder because he thought that Carly did it and he took the rap to protect her." "Do you believe it, Jim? Do you believe that he is innocent? "Yes, I said from the beginning that I believed Edna did it. I just don't have the proof. Now we find that if Bob is telling the truth, then Wayne was dead before 5:30 p.m. when Bob went there. What are we missing, Bobbie?" "For one thing we're missing out on a good hot tub. It's hard to enjoy it when you're thinking about a murder. Okay, Honey, I'll try to remember some key points. Stop me when you hear something that catches your ear." "I love you, Bobbie." "You're going to owe me another trip to this motel and this hot tub. I'm naked in a hot tub and we're talking about a murder victim." "I promise you we are not done making love tonight. Around 2:00 p.m., Wayne goes home and Carly showers before kids get home from school which is around 2:30 p.m. "Wayne goes home and gets in the hot tub. His wife gives him pills and goes shopping. Around 4:00 p.m., Carly goes over and leaves a tape. At around 5:30 p.m., Bob goes over and sees a dead Wayne. Grabs tape to protect wife and goes home. At 6:30 p.m., Edna comes home, discovers body and calls 911. What do you think, Honey?" asks Bobbie, as she sinks deeper into the hot tub. "Something is wrong with the time line. What is it? Didn't the Able's say they saw Bob around 5:30pm? "No, they never mentioned the time. It was the time when Bob came home from work." Bobbie replied to my question. "What's wrong here? What else did the Ables say, Bobbie? They saw Edna leave for shopping and they left about an hour later." Bobbie screamed out. "That's means if they are telling the truth and Bob got home at 5:30 p.m. then they saw Edna leave at 4:30 p.m. Edna said she left at 2:30 p.m. I wonder which is right?" "What if they are both right? What if Edna left at 2:30 p.m. and came back home and then left again when the Ables saw her at 4:30 p.m...." Bobbie took over, "Then Bob went over and saw a dead Wayne. You know what, Jim? It would also explain the pills and the scratches." "Explain what, Bobbie?" I asked her, not thinking about the overdose. "The pills found in his body were not whole pills. Tell me, Jim, if I were to give you two aspirins right now, how would you take them? Swallow them whole or crush them?" "You're right! The pills found in his body were crushed, not whole. So Edna could have crushed up more than one and put it in his beer glass. No one else said anything about his pills. Did I tell you how much I love you, Bobbie?" I was so excited. Bobbie said, "Remember Edna said she knew Wayne had sex when she saw the scratches on his back? If he was in the bathroom when she left, then she wouldn't have seen the scratches on his back till she came home." CSI: The Hot Tub The death was making more sense now. Tomorrow we would have to talk again to the Ables and Edna's daughter Dorothy to find out what time her mom went home. "Are you ready to get back on the bed and make love to me again?" I asked Bobbie. "Only if I can be on top this time." Bobbie smiled. ----------------------------- The next day Bobbie and I felt like a couple of raisins. We probably spent too much time in the spa but we didn't care. It was a good, no it was a wonderful night. I spent time relaxing in a spa. I now have a girlfriend and I'm on my way to solving a crime. Bobbie and I called our superiors and told them of our possible finding and asked to spend the day working on the case. Our first stop was to see the elderly couple, the Ables. They invited us in and asked if we knew that Bob Smith was saying he didn't do it. They told us he was changing his plea. We explained to them that we heard about it and that is why we came to see them. We wanted to hear their story one more time. "What time did you and Mary go out to sit on the porch, Paul?" "I'm not sure, it's been so long ago. Mary, do you remember?" "We came out after the judge show that we always watch. Probably around 4:00 p.m." "Were you out any earlier that day, say 2:00 p.m. to say 3:00 p.m.? "Oh, never! Our court shows come on at 2:00 p.m. and aren't over till 4:00 p.m. We would never come out earlier. Sometimes maybe later but never earlier." "Do you come right out at 4:00 p.m. or maybe a little later, say 4:15 p.m. or so." "Oh, our show is over at 4:00 p.m. We need time to turn off the television and get a glass of tea, maybe even a sweater if it's cool out." "I noticed that when you sit on your porch, you can't see in the Moores' backyard. Could somebody be there without you seeing them?" Paul laughed. "I'm not superman even though Mary calls me that once in awhile. Know what I mean? No, we can't see any goings on in their backyard." "You mentioned that you saw Bob Smith that day. He was walking towards the Moore house." "Yes, we were in our car and you could see Bob walking this way from the street. We would have never seen him if we were on the porch. Good thing we were going to Wal*Mart that day. Otherwise we wouldn't have seen him." "One more question. You said you saw Edna leave about 4:30 p.m. that day. Is that correct?" 'Yes, I remember looking at my watch and she was heading for Wal*Mart too. We saw her there. She looked nervous at the time; she walked around a lot but didn't buy much. Then we heard that when she got home, she discovered Wayne's body. I bet that was some trauma, but Edna handled it well." "I want to thank you two for inviting us in. "She's my girlfriend and you're the first to know." He grinned at me. Bobbie just shook her head and smiled. Our next stop was at Edna's oldest daughter's house. Her name was Dorothy. We knocked on her door and she answered it. "What do you want?" She recognized us from the funeral home. "We just have a couple of questions for you." She didn't even invite us in; instead she came out onto the porch. We knew something was bothering her. "Did you go shopping with your mom the day your dad passed away?" "Yes but not very long." "What's bothering you, Dorothy?" She started crying. "I can't lie; I'm just not a good liar. Mom told me that I should say that I was with her till evening, like 6:00 p.m. But I wasn't. Mom was raving about how bad Dad was and I was tired of hearing it, so after about an hour and a half I went home. I was here at home with my family until Mom called and said Dad was dead. That's when I went and picked her up and brought her here to stay for the night. She cried all night. She really loved my father you know. Maybe too much." "Thank you, Dorothy. Thank you for being honest; it makes our job a little better to know there are still honest people out here." Dorothy was still crying. "God, I hope she didn't do it," she said as she walked back into her house. Even her kids had a feeling. It didn't make our job any happier to know we were about to arrest a sixty-two year old grandmother, although it would set an innocent man free. We called the DA and explained the situation to him. He had a warrant sent out for Edna's arrest. The DA called us and said she confessed. She was glad to get it over with. Even though she didn't like Carly, she had a hard time watching the kids play in the yard knowing their father was in jail for something she had done. She had come home around 4:00 p.m. and as she pulled up she had noticed Carly walking through the yard toward her house. She thought she had come back for more sex. She figured they had done it earlier but now she was sure they had sex. When she saw the scratches on Wayne's back she went berserk. She pushed his head down and had to hold tight as he was trying to get up. But, because of his sleepy state he just choked in the water till he stop moving. Edna said she dried off and tried to clean up a little and tried to regain her composure. She got back in her car and left again for the store. I told the DA that we might have figured it out sooner if Bob wouldn't have confessed. It just kind of stopped our ball from rolling. Epilogue: Edna's court case is due up soon. Temporary insanity is her plea. Bobbie and I rode down the neighborhood street. The Ables were sitting on their porch. So it must have been after 4:00 p.m. The Smith children were playing in the yard with the neighbor kids. The only difference was the 'For Sale' sign was now in the Moores' yard. The last we heard, Carly and Bob were seeking help for their marital problems. We hoped it would work out. They did care for each other. As for me and Bobbie, we walked into the office and one of the guys said, "Look at the ass on that." I quickly turned and said, "Watch it, Bill, she's my girl now." Bill looked at me and winked.
